This unauthorised content policy applies to the uploading or posting of User Content on the Site by Registered Users. Unless the context requires otherwise, the definitions used in the New Account Set Up Form and General Terms of Use "the Agreement") shall apply to this policy. This policy is supplemental to the Agreement and in the case of any inconsistencies, the terms of the Agreement shall prevail.

We do not tolerate the uploading or posting of any User Content that is unlawful, offensive, infringing of another's intellectual property rights or otherwise in breach of the Agreement ("Unauthorised Content"). Although we do not have any obligations to check, verify, endorse or monitor any User Content or otherwise filter or pre-screen any User Content, we will take such action as deemed necessary or appropriate by us in our sole discretion if it is brought to our notice that any person has, or is alleged to have, uploaded or posted any Unauthorised Content.

User Content amounting to Unauthorised Content is set out in the Agreement and includes but is not limited to User Content that :-

(a) is unlawful, harmful, threatening, abusive, harassing, violent, fraudulent, tortious, offensive, defamatory, libellous, scandalous, seditious, vulgar, obscene, indecent, contains pornography, invasive of another's privacy, hateful, racially, ethnically or otherwise objectionable;

(b) such User does not have a right to transmit under any applicable law or under contractual or fiduciary relationships (such as insider information, proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements);

(c) infringing any Intellectual Property Rights or any proprietary rights of any party;

(d) contains unsolicited or unauthorised advertising, promotional materials, "junk mail", "chain letters" or any other form of solicitation;

(e) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or

(f) violates any applicable law particularly relating to copyright, prohibitions on libel, slander and invasion of privacy and relating to electronic signatures and electronics transactions.

We will take such further action as deemed necessary or appropriate by us in our sole discretion which includes but is not limited to :-

(a) seeking a response from the User responsible for uploading or posting the User Content.

(b) requesting the User to remove the Content;

(c) disabling access to part or all of the Project Workplace; and

(d) terminating the Agreement (if applicable) with reserved right to claim damages and / or compensation in relation thereto.

PLEASE NOTE THAT WE DO NOT CHECK, VERIFY, ENDORSE OR MONITOR ANY USER CONTENT OR OTHERWISE FILTER OR PRE-SCREEN ANY USER CONTENT AND ACCORDINGLY, WE CANNOT ACCEPT ANY LIABILITY FOR ANY OF THE USER CONTENT.

We reserve the right to change the terms of this Unauthorised Content Policy at any time by posting any such change on the Site. All such changes will take effect upon posting on the Site.
